These Terms of Service (“Terms”) govern your access to and use of ScreenerHQ (“ScreenerHQ”, “we”, “us”, “our”), including our website, applications, and related services (the “Service”). By accessing or using the Service, you agree to these Terms.

1. What ScreenerHQ Is (and Is Not)

ScreenerHQ is a sports analytics and market-screening tool designed to help users review historical and statistical information. ScreenerHQ is not a bookmaker, sportsbook, betting exchange, or gambling operator. We do not accept bets, handle wagers, or facilitate gambling transactions. Any decisions you make using information from the Service are your responsibility.

2. Eligibility and Responsible Use

You must be at least 18 years old (or the legal age in your jurisdiction) to use the Service. You are responsible for ensuring your use of ScreenerHQ complies with applicable laws and regulations where you live. We advocate responsible gambling: do not gamble with money you cannot afford to lose and seek help if gambling becomes a problem.

3. Accounts, Access, and Security

If you create an account, you agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. If you believe your account has been compromised, notify us immediately at support@screenerhq.com.

4. Service Integrity and Data Rules

ScreenerHQ is designed with integrity constraints that prioritize correctness over completeness. For example, certain percentages and probability-style outputs may be withheld when the underlying sample is not meaningful. Where data is insufficient, outputs may be shown as null/blank. This is intentional and part of the Service’s integrity model.

5. No Advice, No Guarantees

The Service is provided for informational and research purposes only. Nothing on ScreenerHQ constitutes betting advice, financial advice, or investment advice. We do not promise outcomes, profits, “locks,” or guaranteed results. Sports and betting markets are inherently uncertain, and past performance does not predict future results.

6. Acceptable Use

You agree not to misuse the Service. This includes, without limitation: (a) attempting to gain unauthorized access; (b) interfering with performance or availability; (c) reverse engineering or extracting source code except to the extent permitted by law; (d) using automated scripts, bots, scrapers, or similar tools to access or extract data; (e) reselling, redistributing, or sublicensing the Service or its outputs without written permission.

7. Anti-Scraping and Automation Restrictions

To protect data quality, service availability, and fair access, we may use technical safeguards (rate limits, access controls, detection) to prevent scraping and automated extraction. Attempting to bypass these safeguards is prohibited and may result in immediate suspension or termination.

8. Intellectual Property

The Service, including our software, interface, trademarks, and proprietary methods (including screening logic and data presentation), is owned by ScreenerHQ or its licensors and is protected by intellectual property laws. You receive a limited, revocable, non-exclusive, non-transferable right to use the Service for your personal or internal purposes in accordance with these Terms.

9. Third-Party Data and Services

ScreenerHQ may rely on third-party data providers and infrastructure vendors. We do not control and are not responsible for third-party services, including outages, inaccuracies, or changes in availability. Where practical, we attempt to handle missing data gracefully, but we cannot guarantee completeness or uninterrupted access.

10. Subscriptions, Trials, and Payments (If Applicable)

If you purchase a paid plan, you agree to pay the listed fees and any applicable taxes. Access to paid features may be time-based (for example, ending when a subscription expires). Unless otherwise stated, fees are non-refundable except where required by law or where we explicitly approve a refund in writing.

11. Suspension and Termination

We may suspend or terminate your access to the Service at any time if we believe you violated these Terms, used the Service unlawfully, attempted to scrape or abuse the platform, or created risk to the Service or other users. You may stop using the Service at any time.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY ACCURATE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCREENERHQ WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. IN ALL CASES, OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnity

You agree to indemnify and hold ScreenerHQ harmless from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of the Service, violation of these Terms, or violation of any law or third-party rights.

15. Changes to the Service or These Terms

We may update the Service and these Terms from time to time. If we make material changes, we will update the “Last Updated” date and may provide additional notice where appropriate. Your continued use of the Service after changes become effective means you accept the updated Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where ScreenerHQ is incorporated, without regard to conflict of laws principles. If you are unsure of the governing jurisdiction, contact legal@screenerhq.com. Courts in that jurisdiction will have exclusive authority to resolve disputes, except where mandatory local law provides otherwise.
